On 18 July 2019 the Ministry of Housing Communities and Local Government (MHCLG) published a full fund application guidance in respect of private sector ACM Cladding Redemption Fund which aims to help pay for the removal and replacement of unsafe aluminium composite material cladding.
The guidance does not offer a definition of responsible entity but it may be, the building freeholder, the head leaseholder, or a management company which has primary responsibility for the repair of the building.
There is some questions arising out of the guidance where parties to a lease are currently in dispute about the liability to pay for the cost of replacement cladding and other fire safety measures including interim measures, as to how that particular dispute will be affected is not yet known, but it does seem however that assistance from the Government is on hand for the large number of people that are living in high rise accommodation that is clad with materials that are no longer compliant.
There is only a limited time for those responsible for these types of businesses to make the application for funds which close on the 31 December 2019 although it will be possible to request an extension of time if there are legitimate reasons.
